DRAFT. This page is a draft and a lawyer has not reviewed it yet.
It explains how we plan to work. It may change before we take on our first client.
Terms of service
These terms explain how our previews and plans work. We wrote them in plain words. If anything is unclear, ask us.
Who we are
Up the Road Web is owned by Tyler Jackson, based in Union County, SC.
In these terms, "we" and "us" means Up the Road Web. "You" means the business owner who uses our site, looks at a preview, or signs up for a plan.
Free previews
We may build a preview website for your business from public business listings and mail you a postcard about it. Looking at a preview costs nothing and does not sign you up for anything.
A preview is private. It is marked so search engines like Google do not list it, it is labeled as a preview, and it goes away on its own about 45 days after we mail the card.
A preview only shows facts from public listings about your business, plus clearly labeled examples you can change. If anything on it is wrong, tell us and we fix it or take it down.
If you do not want a preview or any more mail from us, text, call, or write to us and say so. We delete your preview and keep a short do-not-contact note so we never mail you again.
Plans
Our plans and prices are on our plans page. What a plan includes is what that page lists on the day you sign up. We only sell what is built and working.
There is no setup fee and no contract. Plans are month to month and you can cancel any time. Our cancellation and refund policy explains how.
Once you sign up and send us what we need, your site goes live on your own domain name within 48 hours. Phone and text features take longer: Usually within three weeks. Phone companies require a registration step.
Paying
Plans are billed each month to your card through our payment company, Stripe. We never see or keep your full card number.
If we ever change a price, we tell you by email at least 30 days before it applies to you. Founding clients keep the rate they signed up at, as promised when they joined.
If a payment fails, we let you know and give you time to fix it before anything on your site changes.
Your business, your content
Your business name, your words, your photos, and your domain name stay yours. You let us use them to build, run, and show your site while you are a client.
We only put facts on your site that you gave us or confirmed. We never make up things like licenses, years in business, awards, or prices.
When you leave, we send you your current site as files you can use, change, and host anywhere, with no fee.
With your OK, we may show your site as an example of our work. You can say no, or change your mind later.
Changes to your site
Text or email us a change. Small changes are included with no set limit. New pages and redesigns are quoted first. Small changes are done within one business day.
Your domain name
You are listed as the owner of your domain from day one.
Domain renewal is about $11 a year. It is included in your monthly price. If you ever leave, that is the only cost you take over. Some domain companies charge a little more.
The domain company will email you once to confirm your contact details. Please click the link in that email. We will remind you until it is done.
Moving your domain somewhere else is free, any time you ask, for any reason. New domains cannot be moved for the first 60 days. That is an industry rule, not ours. After that it takes a few days.
Text messages and phone features
These features are not offered yet. When they are, these rules apply to them:
- Phone companies require a registration for your business before any text can go out. It usually takes one to three weeks.
- You keep your own phone number. We never ask you to move it.
- We only text people who called your business and did not get an answer, people who texted your business first, and customers who asked for a review link themselves. Never a list of numbers. You never upload or type in customer numbers.
- Anyone can reply STOP, or say stop in their own words, and they never get another text from your line.
- We never send marketing texts for you.
Your Google business listing
If your plan includes help with your Google business listing, our Google listing terms apply too. That service is not offered yet.
What we do not promise
- We cannot promise where you show up on Google or how many calls you get. No one honest can.
- We work hard to keep your site up, but no website is up every minute of every day.
- We will never ask for your passwords: not for Google, Facebook, your email, or your bank.
Limits
If something goes wrong because of us, the most we owe you is what you paid us in the three months before it happened. We are not responsible for business you think you lost because your site or a text did not work. Some states do not allow these limits, so they may not apply to you.
You agree not to use our service for anything illegal, or to send anything through it that you do not have the right to send.
If we ever close
If we ever stop running this business, we tell every client at least 60 days ahead. You get your domain and your site files, the same as if you canceled, with no fee.
Disagreements
If you are unhappy, call Tyler first. Most things get fixed that way.
These terms follow South Carolina law. If we cannot settle a disagreement by talking, it goes to a court in Union County, South Carolina, or to small claims court where you are.
Changes to these terms
When we change these terms, we post the new version here with its date. If a change affects a client, we tell you at least 30 days before it applies.
